Terms & Conditions

Overview & Acceptance

  • These Terms of Use (“Terms”) are a binding contract between you and Law Offices of Hass Bashir or Mir & Bashir Law LLC (“M&B,” “we,” “us,” or “our”). They govern your use of any website, app, or online service that links to these Terms, along with all related features, content, and services we control (collectively, the “Service”).
  • Sometimes additional terms appear within the Service (“Additional Terms”). If those conflict with these Terms, the Additional Terms will control for the affected feature unless they say otherwise. You may also enter into a separate engagement letter with M&B (a “M&B Agreement”)—if a M&B Agreement conflicts with these Terms, the M&B Agreement will govern unless it expressly states otherwise.
  • By using the Service, you agree to these Terms and consent to the practices described in our Privacy Policy. If you do not agree, do not use the Service.

Legal Services & Relationship Status

  1. Legal Strategy Session (LSS): The LSS is an initial conversation to understand your matter, gather facts, and suggest specific services that might fit your needs.
  2. Who May Perform Work: If M&B undertakes a representation, some or all work on your matter may be handled by another lawyer or firm serving as co-counsel (“Co-Counsel”). Co-Counsel are independent; they are not M&B’s partners, members, associates, or employees.
  3. No Attorney-Client Relationship Without a Signed M&B Agreement: Submitting a form or contacting us through the Service does not create an attorney-client relationship. That relationship forms only after (i) M&B and, if applicable, any Co-Counsel complete conflict checks and (ii) you, M&B, and where relevant Co-Counsel sign a M&B Agreement. If we cannot accept the matter, any advance fees you paid will be refunded.
  4. Confidentiality Before Engagement: Until a formal attorney-client relationship exists, information you submit may not be protected by the attorney-client privilege. Avoid sharing confidential information through the Service before engagement is confirmed.
  5. No Legal Advice: Materials on the Service are for general information only. They are not legal advice and are not a substitute for consulting a licensed attorney about your specific situation.
  6. Jurisdictions: M&B offers services in Maryland, Virginia & Washington D.C. We do not seek clients where doing so would be unauthorized. Where the Service would be treated as an advertisement or solicitation, it is intended only for jurisdictions where it complies with applicable law and ethics rules.

  8. Choosing Counsel: Deciding whether to hire a lawyer—and whom to hire—should not be based solely on ads or claimed expertise. Consider requesting written information about qualifications and experience and consult the state bar where the lawyer is licensed.
  9. Your Responsibilities Before Engagement: Deadlines and obligations may apply to your matter. Unless and until you sign a M&B Agreement, you are responsible for protecting your rights and meeting any deadlines.
  10. Our Discretion to Respond: We may, in our sole discretion, decide whether and how to follow up on submissions. Incomplete or inaccurate submissions may not receive a response, and we may not retain submitted information.
  11. No Guarantees: Every case is different. Testimonials or past results are not guarantees of outcomes in any other matter.
  12. Client Satisfaction: We aim for client satisfaction. If you are unhappy with services, contact website@bashirlaw.com so we can discuss options. This does not limit any rights you may have under applicable malpractice or consumer-protection laws.
  13. Consent to Contact: By submitting information via the Service, you consent to be contacted by M&B or its agents by phone, text, or email.
  14. Information Sharing with Co-Counsel & Informational Technology partners: You authorize M&B to share your information with potential Co-Counsel and with other technology partners (“partners”), which supports M&B with technology, case/document/accounting/marketing/financing and related non-legal services.   These third party entities may or may not be law firms and would not provide legal advice.
  15. “Your Personalized Plan” (AI Tool): Any AI-generated planning tool is informational only, does not create an attorney-client relationship, and is not legal advice. Submissions through this tool are not confidential or privileged. Consult a licensed attorney for advice tailored to your facts.

Using the Service

  1. Content Ownership
    • The Service includes content related to M&B and third parties (collectively, “Content”), including site layout, text, graphics, software, images, videos, trademarks, and trade dress. M&B and/or its licensors own all rights in the Service and the Content, protected by U.S. and international laws.
  2. Limited License
    • Subject to these Terms, applicable Additional Terms, and any M&B Agreement, M&B grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Content on your personal devices for non-commercial, personal use. This license conveys no ownership and may be suspended or terminated at any time.
  3. Prohibited Conduct
    • You must be at least 18 to use the Service. You agree not to: (1) use the Service or Content for political or commercial purposes; (2) engage in unlawful, harassing, offensive, or otherwise objectionable activity; (3) harvest data; (4) reverse engineer or modify the Service; (5) disrupt security or operations; (6) infringe others’ rights; (7) imply any unauthorized association; or (8) violate these Terms, any M&B Agreement, or any Additional Terms. Comply with all applicable laws and regulations when using the Service.
  4. Availability
    • We may suspend or terminate the Service, in whole or in part, at any time and for any reason. Upon notice or termination, your license ends immediately. You may keep copies of documents you downloaded from or uploaded to the Service.
  5. Reservation of Rights
    • All rights not expressly granted are reserved by M&B and its licensors.

Unsolicited Submissions

  • If you send M&B any ideas, feedback, content, or other materials (“Submissions”), you grant M&B a worldwide, perpetual, irrevocable, transferable, royalty-free license to host, display, reproduce, modify, adapt, distribute, create derivative works from, perform, and otherwise use the Submissions for any purpose and to sublicense those rights. You waive (and, where not waivable, agree not to assert) any moral rights in your Submissions. You will not receive compensation for Submissions, and our receipt does not admit novelty or originality.

You represent you have all rights necessary for any content you provide.

  • DMCA Notices
    • M&B responds to notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512. A proper notice must include: (i) a physical or electronic signature of the copyright owner or agent; (ii) identification of the copyrighted work; (iii) identification of the allegedly infringing material and information reasonably sufficient to locate it; (iv) your contact information (including postal address, phone, and website@bashirlaw.com); (v) a statement of good-faith belief that the use is unauthorized; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

  • Counter-Notices
    • If you believe your material was removed in error, send a counter-notice to the Designated Agent including: (i) your physical or electronic signature; (ii) identification of the material removed and where it appeared; (iii) a statement under penalty of perjury that the removal was a mistake or misidentification; and (iv) your name, address, and phone number, plus a statement consenting to the jurisdiction of the federal district court where you reside (or any district where M&B may be found if outside the U.S.) and agreeing to accept service from the original complainant or its agent. We will process counter-notices consistent with the DMCA.

Accuracy of Service Information

We aim to keep the Service current and accurate, but errors may occur. We do not guarantee that offerings, pricing, or other content are complete, accurate, or up to date.

Information You Provide

Information and documents you provide to M&B or to lawyers working with M&B in connection with the Service are subject to our Privacy Policy. By using the Service, you consent to the practices described there. If you do not agree, do not provide information and discontinue use.

Customer Support & AI Tools

You grant M&B the right to use any intake or onboarding data, documents, communications, and other free-text information you provide (“Input Data”) to develop, train, and improve models, algorithms, tools, and related AI products. Output generated from Input Data (“Output”) may be produced using AI. You acknowledge: (i) you will not provide unnecessary or deceptive Input Data; (ii) AI may be inaccurate; (iii) you must verify Output before relying on it; (iv) unverified reliance may cause harm; and (v) you have no rights to materials generated for other customers, even if similar. M&B does not warrant that any AI tools meet your requirements. You are responsible for obtaining any consents needed for personal information you submit and will indemnify M&B for failures to do so.

Third-Party Services

The Service may link to or integrate third-party sites, services, platforms, or technologies (“Third-Party Services”). We do not control and are not responsible for Third-Party Services, their content, or results. Your use is at your own risk. See our Privacy Policy for more information.

Service Features

  1. Wireless Features
    • Using the Service on a mobile device may allow device-based features. We may collect information per our Privacy Policy and adjust settings to optimize your experience. Carrier data rates may apply.
  2. Location Features
    • If you enable location services, your device location may be collected and used consistent with the Privacy Policy. You can disable via device permissions or by uninstalling the app. Location data may be inaccurate.
  3. Communications
    • (i) Emails. You can opt out of certain promotional emails by following the unsubscribe instructions or emailing website@bashirlaw.com with “UNSUBSCRIBE” in the subject line. Transactional or case-related emails will continue.
    • (ii) Push Notifications. Disable via device settings or uninstall the app.
    • (iii) Calls. We may call the number you provide (including via autodialer or prerecorded messages) for transactional or direct-marketing purposes. Consent is not a condition of purchase. You may opt out during any call or by contacting us; the opt-out applies only to the number provided.

SMS Terms

If you opt in, you may receive texts about appointments, your case, recommended services, offers, and promotions.

Dispute Resolution; Arbitration; Governing Law

  • Agreement to Arbitrate
    • Except for claims seeking injunctive relief for alleged misuse of M&B’s intellectual property, you and M&B agree to resolve disputes related to these Terms through final and binding arbitration.
  • What Arbitration Is
    • Arbitration is a private, typically faster alternative to court. A neutral arbitrator may award the same relief a court could. If any provision of this arbitration section is unenforceable, it will be severed and the rest enforced.
  • Procedures
    • The Federal Arbitration Act applies. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures before one arbitrator. Where these Terms and the JAMS Rules conflict, these Terms control. See http://www.jamsadr.com or call 1-800-352-5267 for filing instructions.
    • To start arbitration, a party must: (1) draft a demand describing the claim and requested damages (forms at www.jamsadr.com); (2) send three copies plus the filing fee to your local JAMS office or JAMS, Two Embarcadero Center, Suite 1500, San Francisco, CA 94111; and (3) send one copy to the other party.
    • Fees are governed by JAMS Rules. If travel to California is a burden, you may appear by phone or on papers to the extent allowed. Each side pays its own costs unless the arbitrator finds your share would be an undue burden, in which case M&B will pay administrative costs (not attorneys’ fees). Arbitration will be held in San Diego, California, under California law (without regard to conflicts rules). Individual relief available in court is available in arbitration. Any award may be entered in any court with jurisdiction.
  • Arbitrator’s Authority
    • The arbitrator decides the rights and liabilities of the parties. No consolidation or joinder with other cases. The arbitrator may decide dispositive motions, award damages, and grant individual injunctive or equitable relief as permitted by law and these Terms. A written decision will state essential findings and the basis for any award.
  • No Class Actions
    • Disputes must be brought on an individual basis only.
  • Jury Trial Waiver
    • If litigation occurs to enforce or vacate an award (or otherwise where allowed), both parties waive the right to a jury, opting for resolution by a judge. You acknowledge you may consult counsel before agreeing to arbitrate.
  • Governing Law & Venue
    • Where a claim may proceed in court, these Terms are governed by California law (without conflicts rules), and exclusive venue lies in courts located in San Diego, California.

Disclaimers

THE SERVICE IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” M&B AND ITS ASSOCIATED PERSONS (THE “M&B PARTIES”) DISCLAIM ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND FREEDOM FROM VIRUSES. YOUR USE IS LAWFUL ONLY IF PERMITTED BY THE JURISDICTIONS WHERE YOU ACCESS THE SERVICE. THESE DISCLAIMERS DO NOT LIMIT NON-WAIVABLE CONSUMER RIGHTS OR LIABILITY FOR PERSONAL INJURY, OR FOR INTENTIONAL MISCONDUCT, RECKLESSNESS, FRAUD, OR GROSS NEGLIGENCE BY M&B.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE M&B PARTIES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR FOR LOSS OF PROFITS, DATA, USE, BUSINESS, GOODWILL, OR SYSTEM FAILURE, ARISING FROM (A) THE SERVICE, (B) THESE TERMS, OR (C) MISUSE OF THE SERVICE OR CONTENT—WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, STATUTE, OR OTHERWISE. THIS SECTION DOES NOT LIMIT NON-WAIVABLE CONSUMER RIGHTS OR LIABILITY FOR PERSONAL INJURY, OR FOR INTENTIONAL MISCONDUCT, RECKLESSNESS, FRAUD, OR GROSS NEGLIGENCE BY M&B.

Indemnification

You agree to defend, indemnify, and hold harmless the M&B Parties from and against claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) arising out of: (i) your breach of these Terms; (ii) your Submissions; (iii) misuse of the Service; (iv) violations of law; (v) infringement or violation of third-party rights; (vi) your use of Third-Party Services; or (vii) any misrepresentation by you. M&B may assume the exclusive defense at your expense; you will not settle without M&B’s prior written consent. This does not require indemnification for M&B’s fraud or unlawful practices.

Waiver of Equitable Relief

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE NOT TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF THAT WOULD RESTRAIN OR INTERFERE WITH THE DEVELOPMENT, OPERATION, OR EXPLOITATION OF ANY WEBSITE, APPLICATION, CONTENT, SUBMISSION, PRODUCT, SERVICE, OR INTELLECTUAL PROPERTY OWNED OR CONTROLLED BY M&B OR ITS LICENSORS.

Changes to These Terms

We may modify these Terms or any Additional Terms at any time. We may notify you by posting updated terms on the Service (e.g., via a link on the home page) and/or by email to your last provided address. Changes are effective when posted (or on a later date stated in the notice). If you object, your remedy is to stop using the Service.

General Provisions

  • Consents and Approvals
    • No consent or approval from M&B is valid unless in a writing signed by a M&B officer.
  • Survival
    • Sections that by nature should survive termination (including those on use restrictions, submissions, copyright, posted information, provided information, support, third-party services, features, dispute resolution, disclaimers, limitations, indemnification, waiver of equitable relief, updates, and general terms) will survive.
  • Severability; Interpretation; Assignment
    • If any term is invalid or unenforceable, it is severed and the remainder remains effective. Headings are for convenience only. You waive any rule construing a contract against its drafter. M&B may assign its rights and obligations, in whole or part, at any time. You may not assign or delegate without M&B’s prior written consent.
  • Entire Agreement; No Waiver
    • These Terms and any applicable Additional Terms are the complete agreement regarding the Service and supersede prior discussions. No delay or failure to enforce any term is a waiver. Modifications or waivers must be in a signed writing against the party to be bound. (Separately executed M&B Agreements and payment agreements are not limited by this paragraph.)
  • International Use; Export Controls
    • The Service is controlled from the United States and may not be appropriate or available elsewhere. The U.N. Convention on Contracts for the International Sale of Goods does not apply. Software may be subject to U.S. export laws; you agree not to export or re-export except as authorized.
  • Investigations; Law Enforcement
    • M&B may investigate suspected violations and cooperate with law enforcement or regulators by disclosing information as legally required.
  • California Consumer Rights & Notices
    • Certain consumer rights may apply under California law. M&B may investigate and prosecute suspected violations and disclose information as needed to satisfy legal obligations and governmental requests.
