Frequently Asked Questions

Virginia law, under Code § 20-124.2, requires detailed parenting plans that reflect the best interests of the children, outlining decision-making for education, health, and visitation to promote stability and co-parenting while minimizing court intervention.

We work closely with you to draft comprehensive agreements addressing all aspects of your children’s lives—from education and health care to visitation—ensuring they meet legal requirements, foster positive co-parenting, and protect your family’s well-being.

Plans cover schooling (choices, extracurriculars, expenses), health care (medical decisions, cost-sharing), visitation schedules (weekly, holidays, travel), day care, religion, grandparents’ contact, and provisions for work schedules or communication to support the child’s stability.

Plans must be submitted to the court for approval and incorporation into the custody order, reviewed for the child’s best interests (§ 20-124.3). Enforcement occurs via motions for contempt if violated, with modifications allowed for material changes like relocation.

Effective July 1, 2025, Virginia guarantees parents online access to their child’s academic and health records, enhancing transparency in co-parenting plans. Additionally, child support guidelines were updated via SB 805, raising the income cap to $42,500 and revising schedules, impacting financial provisions in custody agreements.
